At KAMA it is company policy, firstly, to adhere strictly to US immigration laws and, secondly, to obtain the best possible working visa for which a candidate qualifies. KAMA does not cut corners when it comes to the legal requirements for your entry into the US.  We retain excellent attorneys who will ensure that your visa application is handled correctly and expeditiously.  Most of the computer professionals recruited by KAMA fall into the "H-1B" category, which is a visa granted to persons of "distinguished merit and ability in the Arts and Sciences." This visa is usually granted for an initial period of three years and can be renewed for a further three years. In order to qualify for the H-1B visa, you will need documentation to prove that you have one of the following: 

1. A four-year Bachelors degree with computer related subjects as a significant part of the curriculum; 

2. A tertiary computer education, such as a Technical College Diploma or training courses, plus several years industry experience - the combination should be substantial enough to be equated to at least 12 years professional experience;

3. With no tertiary educational qualifications, at least 12 years professional experience.

As soon as we receive your written acceptance of our job offer along with documentation supporting your education and experience, KAMA proceeds with your visa application. An application is submitted to the INS. It is important to realize that the INS does not issue the actual Entry Visa, but merely determines whether you are classifiable under a particular category and then sends their decision to the US Consulate in your country. When KAMA is notified that this has been done, you will need to go to the Consulate and personally complete the necessary Entry Visa Application to have the visa entered into your passport.  Only after completion of this step, KAMA advises you to resign from your present employment. We are then in a position to discuss your arrival date in the US and to make travel arrangements on your behalf. These arrangements are flexible enough to allow you enough time for final preparations, but we would like you to be in the US within 90 days after your visa is approved.  Upon your arrival in the United States you are personally welcomed at the airport by a KAMA staff member, who takes you to your accommodation and discusses further arrangements with you. We provide you with a complete check list of arrangements that need to be made during the first week to ensure that nothing is omitted. Rest assured that it is our job to guide you every step of the way through the transition.  Another important factor to consider is the status of a spouse accompanying a KAMA employee to the US. Usually spouses are automatically issued with a visa which allows them to enter the country but not to take up employment there, unless they are able to secure an employment contract and working visa on the strength of their own qualifications. Couples are presented with a challenge to get the unemployed partner adequately involved in interesting pursuits, such as studying, community activities or volunteer work. Our experience has shown that financial considerations cause many employees to start off as "one-car" families, in which case their proximity to town centers, railway stations, bus stations or parks becomes an important factor to consider when selecting accommodation.  We suggest that the question of the unemployed spouse's well-being should feature prominently in the decision whether to accept a work contract in the US.  It is also advisable for both partners to be involved in the decision making process right from the start. 

Permanent residence in the US

An Immigrant Visa ("Green Card") changes the status of a Non-immigrant Visa holder ("Alien") to that of Permanent Resident of the United States. An individual may apply for an Immigrant Visa provided he/she has a Sponsor willing to provide the applicant with employment when the Visa is granted.  At present it is KAMA company policy to act as the Sponsor for an employee who is in good standing with the company. Our policy regarding sponsorship for Immigrant Visas is as follows: 

·         An Immigrant Visa applicant must have been in the employ of KAMA for a minimum period of at least six (6) months before an application may be made. 

·         Agreement from KAMA to act as Sponsor in the application for an Immigrant Visa must be obtained in writing before the application is made. 

·         KAMA will reimburse legal fees incurred in connection with the Immigrant Visa application up to a maximum of $3,500, and limited to $500 per month (or $250 per pay period) upon submission of invoices. 

·         The employee should use the services of the immigration attorney of his/her choice to process the Immigrant Visa application, and the attorney will represent the employee, not KAMA. 

·         In the event that the employee leaves KAMA before being granted an Immigrant Visa, the employee will reimburse KAMA for all moneys the company has paid towards the cost of the Immigrant Visa.
